Implication Covid-19 Pandemic against Indonesian business (Volume 2)

Employment Issue – Balancing Business Continuity and Manpower’s Rights due to the Pandemic.

Many policies that have been issued by the Government of Indonesia to deal with COVID-19 outbreak, among others, work from home policy and certain reduction of business operation.

These policies are disrupting businesses and now companies are facing with employment issues.

Jakarta, as the capital city and the epicentre of the COVID-19 outbreak In Indonesia is subjected to such policies issued by the Governor and the Head of Manpower, Transmigration and Energyo of DKI Jakarta Province. Based on these policies, companies in Jakarta are expected to take preventive measure in relation to COVID-19 pandemic.

In order to ensure business continuity and employees protection due to the said business disruption, the Minister of Manpower issued a Circular Letter Number M/3/HK.04/III/2020 of 2020 dated 17 March 2020 which requested Governors through-out Indonesia to (i) sought for prevention of the spreading of and handling cases related to COVID-19 within the work environment; and (ii) implement wages protection for employees related to COVID-19.

In this client update, we will explain the measure that are subjected to companies in Jakarta.

Then, we will further discuss on the questions relating to employment issue from the business perspective.

Pandemi

Sejumlah kebijakan telah diterbitkan oleh Pemerintah Indonesia untuk mengatasi wabah COVID-19, antara lain, kebijakan work from home dan pembatasan tertentu terhadap kegiatan usaha. Kebijakan-kebijakan ini mempengaruhi dunia usaha dan saat ini perusahaan-perusahaan menghadapi permasalahan ketenagakerjaan.

Jakarta, sebagai ibu kota dan pusat penyebaran wabah COVID-19 di Indonesia juga terkena kebijakan-kebijakan tersebut yang diterbitkan oleh Gubernur dan Kepala Tenaga Kerja, Transmigrasi dan Energi Provinsi Jakarta. Berdasarkan kebijakan-kebijakan dimaksud, perusahaan-perusahaan di Jakarta diharapkan untuk mengambil langkah pencegahan sehubungan dengan pandemi COVID-19.

Untuk menjaga kelangsungan usaha dan perlindungan terhadap karyawan yang disebabkan oleh terganggunya dunia usaha sebagaimana disebukan sebelumnya, Menteri Tenaga Kerja mengeluarkan Surat Edaran Nomor M/3/HK.04/III/2020 of 2020 tertanggal 17 Maret 2020 yang meminta seluruh Gubernur di Indonesia untuk (i) mengupayakan pencegahan penyebaran dan penanganan kasus terkait COVID-19 di lingkungan kerja; dan (ii) melaksanakan pelindungan pengupahan bagi pekerja/buruh terkait pandemi COVID-19.

Pada client update ini kami kan menjelaskan tindakan-tindakan pencegahan yang perlu dilakukan oleh perusahaan-perusahaan di Jakarta. Selanjutnya, kami juga akan menjelaskan lebih jauh mengenai pertanyaan-pertanyaan terkait dengan permasalahan ketenagakerjaan dari sudut pandang dunia usaha.
