Shipping & Maritime Issue – Efforts to Maintain Shipping Contracts in the midst of COVID-19 Pandemic

Since Covid-19 has been declared as a non-nature national disaster, business activities in sea transportation services and other similar business activities, are not exempted from business disruption as a result of restrictions in the port and terminal areas throughout Indonesia. That disruption of business does not only affect the operational activities, but also expose to potential risk of disputes in shipping contracts.

The Government of Indonesia through the Directorate General of Sea Transportation (“DGST”) had taken various measures to prevent the spread of Covid-19 in every Indonesian ports and terminals. Among others is by issuing a DGST Circular No. 5 of 2020 dated February 5, 2020, in which DGST requires all Port Operators to identify ship arrivals from abroad.

In addition, Ministry of Transportation also issued the Minister of Transportation Regulation No. PM 18 of 2020 concerning Transportation Control for the Prevention of Covid-19 Dissemination, which among others regulates concerning stevedoring activities for goods to be used for handling Covid-19, essential goods and the application of physical distancing for officers at the port.

In this Client Update, ARMA Law will discuss and identify possible legal issues related to the implementation of sea transportation contracts.

Topik Pengangkutan Laut – Upaya Mempertahankan Kontrak Pengangkutan Laut di tengah Pandemi COVID-19

Sejak ditetapkannya Covid-19 sebagai bencana nasional non-alam, kegiatan usaha jasa transportasi laut serta kegiatan usaha sejenis lainnya, tidak luput dari berbagai macam disrupsi usaha sebagai akibat dari pembatasan di wilayah pelabuhan dan terminal di seluruh Indonesia. Disrupsi usaha tersebut tidak hanya berpengaruh terhadap kegiatan operasional namun juga terhadap potensi risiko sengketa di dalam kontrak pengangkutan laut.

Pemerintah Indonesia melalui Direktorat Jenderal Pengangkutan Laut (“DJPL”) telah melakukan berbagai tindakan pencegahan virus Covid-19 di setiap pelabuhan-pelabuhan dan terminal-terminal. Salah satunya adalah dengan menerbitkan Surat Edaran DJPL No. 5 Tahun 2020 tertanggal 5 Februari 2020, di mana DJPL mewajibkan kepada seluruh Penyelenggara Pelabuhan untuk melakukan identifikasi terhadap kedatangan kapal dari luar negeri.

Selain itu, Kementerian Perhubungan juga menerbitkan Peraturan Menteri Perhubungan No. PM 18 Tahun 2020 tentang Pengendalian Transportasi Dalam Rangka Pencegahan Penyebaran Covid-19, yang termasuk di antaranya mengatur mengenai kegiatan bongkar muat logistik bagi barang-barang yang akan digunakan untuk penanganan Covid-19, barang kebutuhan pokok, penting dan esensial serta penerapan jaga jarak (physical distancing) bagi para petugas di pelabuhan.
