Madrid Protocol as a Form of Protection of Trademark Internationally

Madrid Protocol is an international agreement signed by member countries of the World Intellectual Property Organization (“WIPO”) in 1989 on the basis of international trademark registration. 

As a country that actively participates in world trade, Indonesia ratified the Madrid Protocol through Presidential Regulation No. 92 of 2017 regarding the Ratification of Protocol Relating to  the Madrid Agreement concerning the International Registration of Mark, 1989 (“PR 92/2017”). 

By registering a trademark using the Madrid Protocol, the registered trademark is protected worldwide. In addition, Madrid Protocol also has a simple, fast, and cost-effective procedure.

Madrid Protocol sebagai Bentuk Perlindungan Hukum Merek Secara Internasional 

Madrid Protocol atau Protokol Madrid (“Madrid Protocol”) adalah perjanjian internasional yang  ditandatangani oleh negara-negara anggota World Intellectual Property Organization (“WIPO”) pada  tahun 1989 atas dasar pendaftaran merek internasional.

Sebagai negara yang turut aktif dalam perdagangan dunia, Indonesia meratifikasi Madrid Protocol  melalui Peraturan Presiden Nomor 92 Tahun 2017 tentang Pengesahan Protokol Terkait dengan  Persetujuan Madrid Mengenai Pendaftaran Merek Secara Internasional (“Perpres 92 Tahun 2017”). 

Pendaftaran merek menggunakan Madrid Protocol memiliki keuntungan di mana merek yang  didaftarkan mendapatkan perlindungan di seluruh dunia. Selain itu, Madrid Protocol juga  mempunyai prosedur yang sederhana, cepat, dan hemat biaya.
