Omnibus Law Employment Cluster – Fixed Term Employment Agreement

Employment cluster is one of the major issues addressed by Law Number 11 of 2020 on Job Creation (“Omnibus Law”). Where recently the government of Indonesia passed Government Regulation Number 35 of 2021 on Fixed Term Employment Agreement, Outsourcing, Working Hours and Rest Hours, and Termination of Employment Relationship (“GR 35/2021”).
This ARMA Update will discuss one of the key points in GR 35/202 which limited to the new arrangement for fixed term employment agreement (perjanjian kerja waktu tertentu – “PKWT”), notably the requirement for PKWT and the new mandatory compensation money for the employee upon the expiry of employment agreement.

Omnibus law – Perjanjan Kerja Waktu Tertentu
Klaster Ketenagakerjaan adalah salah satu isu utama yang diatur dalam Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (“Omnibus Law”). Dimana baru-baru ini pemerintah Indonesia mengeluarkan Peraturan Pemerintah Nomor 35 Tahun 2021 tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat dan Pemutusan Hubungan Kerja (“PP 35/2021”).
ARMA Update ini akan membahas salah satu poin-poin utama dalam PP 35/2021 terbatas mengenai pengaturan baru terhadap perjanjian kerja waktu tertentu (“PKWT”) terkait dengan persyaratan PKWT dan kewajiban mengenai pembayaran uang kompensasi dalam hal berakhirnya perjanjian kerja.
