The Legal Development of Crypto Asset in Indonesia

Crypto assets are legal under Indonesian law as regulated under BAPPEBTI Reg 5/2019. However, up till now the crypto assets may not be used as the digital currencies (cryptocurrencies) due to such limitation as regulated under Currency Law. To date, there are 229 of crypto assets that may be traded in Indonesia as designated by Head of BAPPEBTI under BAPPEBTI Reg 7/2020. Further, trade of crypto asset may only be facilitated by Future Exchange (Bursa Berjangka) and Futures Clearing House (Lembaga Kliring Berjangka) and assisted by Crypto-Asset Broker.

In this ARMA Update, we elaborated further one of the key points on the development of crypto asset in Indonesia from legal perspective, including but not limited to the provisions under MoT Reg 99/2018 and BAPPEBTI Reg 5/2019.

Perkembangan Hukum Aset Kripto di Indonesia

Aset Kripto secara sah dapat diperdagangkan di Indonesia berdasarkan Peraturan BAPPEBTI 5/2019. Namun, aset kripto belum dapat digunakan sebagai mata uang digital karena batasan yang ada di dalam UU Mata Uang.

Terdapat 229 aset kripto yang dapat diperdagangan di Indonesia sebagaimana yang ditentukan oleh Kepala BAPPEBTI dalam Peraturan BAPPEBTI 7/2020. Selain itu, perdagangan aset kripto hanya dapat difasilitasi oleh Bursa Berjangka dan Lembaga Kliring Berjangka, serta dibantu oleh Pedagang Kripto.

Pada ARMA Update ini, kami akan mengupas lebih lanjut tentang poin-poin utama perkembangan aset kripto di Indonesia dalam perspektif hukum, termasuk tapi tidak terbatas pada ketentuan-ketentuan dalam Permendag 99/2019 dan Peraturan BAPPEBTI 5/2019.
