Minister of Transportation No. PM 58 of 2021 (Permenhub 58 Tahun 2021) Concerning Maritime Labour Convention 2006 Certification
Maritime Labour Convention 2006 (“MLC”) is a convention organized by the International Labour Organization (“ILO”) in 2006 in Geneva, Switzerland. MLC aims to ensure the rights of seafarers around the world are protected and provide standard guidelines for each country and ship owner to provide a comfortable working environment for seafarers.
Indonesia is one of the member states participating in the MLC. To provide protection for seafarers and ship crews working on ships, the Government of Indonesia is committed to ratifying the MLC, which begins with the establishment of the ratification in Law No.15 of 2016 Concerning MLC Establishment (“Law 15/2016”), after the ratification then it needs a derivative regulations so that the substance of MLC can be implemented, these regulations are Government Regulation No.31 of 2021 regarding the implementation of the Shipping Sector (“GR 31/2021”) and Minister of Transportation Regulation No. PM 58 of 2021 concerning MLC Certification which enacted on 9 June 2021 (“MoT 58/2021” ).
With the enactment of MoT 58/2021, the provisions of the MLC can be implemented to Indonesian law, to ensure the legal certainty of the rights of Indonesia seafarers and crew members working on Indonesian flagships.

Peraturan Menteri Perhubungan No.PM 58 tahun 2021 tentang Sertifikasi Maritime Labour Convention 2006
Maritime Labour Convention 2006 (“MLC”) adalah konvensi yang diselenggarakan oleh International Labour Organization (“ILO”) pada tahun 2006 di Geneva, Swiss. MLC bertujuan untuk memastikan hak-hak para pelaut di seluruh dunia dilindungi dan memberikan standar pedoman bagi setiap negara dan pemilik kapal untuk menyediakan lingkungan kerja yang nyaman bagi pelaut
Indonesia merupakan salah satu negara yang ikut serta dalam MLC, untuk memberikan perlindungan bagi pelaut dan awak kapal yang bekerja di atas kapal, Pemerintah Indonesia berkomitmen untuk meratifikasi MLC 2006, yang diawali dengan disahkannya ratifikasi dalam UU No.15 Tahun 2016 tentang Pengesahan MLC (“UU 15/2016”), setelah ratifikasi maka diperlukan peraturan turunan agar substansi MLC dapat dilaksanakan, peraturan tersebut adalah Peraturan Pemerintah No.31 tahun 2021 tentang penyelenggaraan Bidang Pelayaran (“PP 31/2021”) dan Peraturan Menteri Perhubungan No.PM 58 tahun 2021 tentang Sertifikasi MLC yang ditetapkan pada 9 Juni 2021 (“Permenhub 58/2021”).
Dengan diberlakukannya Permenhub 58/2021, maka ketentuan-ketentuan dalam MLC dapat diaplikasikan dalam hukum Indonesia, sehingga dapat memberikan kepastian hukum terhadap hak-hak pelaut dan awak kapal Indonesia yang bekerja di atas kapal berbendera Indonesia.
