ESG Update: Key takeaways of Minister of Environment and Forestry Regulation No. 21 of 2022 on the Guidelines of Carbon Economic Value Implementation
Last year, the Presidential Regulation No. 98 of 2021 concerning the Implementation of Carbon Economic Value for Achieving Nationally Determined Contribution (“NDC”) Targets and Control of Greenhouse Gas (“GHG”) Emissions in National Development (“PR 98/2021”) was issued, which we have highlighted the critical points of PR 98/2021 in this ARMA Update. PR 98/2021 introduced the Carbon Economic Value (Nilai Ekonomi Karbon or “NEK”) mechanisms that needed further regulation in the implementing regulation, which we discussed in this ARMA Update.
Recently, the Minister of Environment and Forestry (“MOEF”) Regulation No. 21 of 2022 regarding the Guidelines of Carbon Economic Value Implementation (“MOEF Reg 21/2022”) was issued as the implementing regulation of PR 98/2021 to provide detailed provisions for the execution of NEK. This ARMA Update will cover the crucial aspects stipulated in MOEF Reg 21/2022, including the mechanism for domestic carbon trading, international carbon trading, buffer obligation, voluntary carbon market, and mutual recognition.

ESG Update: Intisari Peraturan Menteri Lingkungan Hidup dan Kehutanan No. 21 Tahun 2022 tentang Tata Laksana Penerapan Nilai Ekonomi Karbon
Tahun lalu, Peraturan Presiden No. 98 Tahun 2021 tentang Penyelenggaraan Nilai Ekonomi Karbon untuk Pencapaian Target Kontribusi yang Ditetapkan secara Nasional (“NDC”) dan Pengendalian Emisi Gas Rumah Kaca (“GRK”) dalam Pembangunan Nasional (“Perpres 98/2021”) diterbitkan, yang telah kami uraikan poin-poin intinya dalam ARMA Update ini. Perpres 98/2021 memperkenalkan mekanisme Nilai Ekonomi Karbon (“NEK”) yang memerlukan pengaturan lebih lanjut dalam peraturan pelaksanaan, yang telah kami bahas dalam ARMA Update ini.
Baru-baru ini, Peraturan Menteri Lingkungan Hidup dan Kehutanan (“KLHK”) No. 21 Tahun 2022 tentang Tata Laksana Penerapan Nilai Ekonomi Karbon (“PermenLHK 21 Tahun 2022”) diterbitkan sebagai peraturan pelaksanaan dari Perpres 98/2021 untuk memberikan rincian ketentuan pelaksanaan NEK. ARMA Update ini akan membahas aspek-aspek penting yang diatur dalam PermenLHK 21/2022, termasuk mekanisme perdagangan karbon domestik, perdagangan karbon internasional, kewajiban penyediaan cadangan pengurangan emisi (buffer), pasar karbon sukarela, dan kerja sama saling pengakuan.
