Kepmenhub No 8 Tahun 2023 - ESG: Climate Change Mitigation Actions in Transportation Sector based on Minister of Transportation Decree No. KM 8 of 2023
In order to achieve the Indonesian Government’s commitment to reduce greenhouse gas (“GHG“) emissions as reflected in Indonesia’s Enhanced Nationally Determined Contribution (ENDC) which also mandated in the Presidential Regulation No. 98 of 2021 on Carbon Pricing for Achieving NDC Target and Controlling GHG Emission in National Development, it is necessary to take steps or actions to mitigate climate change, especially in the transportation sector. In this regard, The Minister of Transportation (the “MOT”) recently issued MOT Decree No. KM 8 of 2023 on Determination of Climate Change Mitigation Actions in the Transportation Sector to Achieve National Contribution Targets, which categorizes the transportation mitigation actions into 4 (four) categories, which are (i) Energy Efficiency; (ii) Utilization of New and Renewable Energy; (iii) Energy Efficiency and Utilization of New and Renewable Energy; and (iv) Forestry and Other Land Sector.

Dalam rangka mewujudkan komitmen Pemerintah Indonesia untuk menurunkan emisi gas rumah kaca (“GRK“) sebagaimana tercermin dalam Enhanced Nationally Determined Contribution (ENDC) Indonesia yang juga diamanatkan dalam Peraturan Presiden No. 98 Tahun 2021 tentang Penyelenggaraan Nilai Ekonomi Karbon untuk Pencapaian Target Kontribusi yang Ditetapkan Secara Nasional dan Pengendalian Emisi Gas Rumah Kaca dalam Pembangunan Nasional, perlu ditetapkan langkah-langkah atau aksi-aksi mitigasi perubahan iklim yang salah satunya terkhusus di bidang transportasi. Sehubungan dengan hal tersebut, Menteri Perhubungan (“Menhub”) baru-baru ini mengeluarkan Keputusan Menhub No. KM 8 Tahun 2023 (Kepmenhub No 8 Tahun 2023) tentang Penetapan Aksi Mitigasi Perubahan Iklim Sektor Transportasi Untuk Pencapaian Target Kontribusi Yang Ditetapkan Secara Nasional, yang mengkategorikan aksi mitigasi transportasi kedalam 4 (empat) kategori, yakni: (i) Efisiensi Energi; (ii) Pemanfaatan Energi Baru Terbarukan (EBT); (iii) Efisiensi Energi dan Pemanfaatan EBT; (iv) dan (iv) Kehutanan dan Sektor Lahan Lainnya.
