[Surat Ditjen Minerba No. B-1605/mb.05/djb.b/2021] – Implikasi Larangan Ekspor Batubara

The Implication of the Coal Export Ban to Shipping Contract
The Directorate General of Mineral and Coal (“DGMC”) of the Ministry of Energy Mineral Resources of Indonesia (“MEMR”) issued a policy to ban Indonesian mining companies from exporting coal. This prohibition is set out in the DGMC letter No. B-1605/MB.05/DJB.B/2021 regarding the Fulfilment of Coal Energy for Public dated 31 December 2021 (“DGMC Letter 1605/2021”).
DGMC Letter 1605/2021 prohibits Indonesian coal producers from exporting coal for the period between 1 January 2022 to 31 January 2022 and requires coal which has been loaded and placed at the loading port and/or loaded onto vessels, to be immediately redirected and delivered to Indonesia’s state-owned power company in order to fulfil Domestic Market Obligation (DMO).
ARMA Update will discuss the issues arise from the above export ban on the shipping activities for the exporters or sellers, also to the shipowners under charterparties.

Implikasi Larangan Ekspor Batubara terhadap Kontrak Pengangkutan
Direktorat Jenderal Mineral dan Batubara (“Ditjen Minerba”) Kementerian Energi Sumber Daya Mineral Indonesia (“ESDM”), mengeluarkan kebijakan yang melarang perusahaan pertambangan mengekspor batubara. Larangan ini tertuang dalam Surat Ditjen Minerba No. B-1605/MB.05/DJB.B/2021 tentang Pemenuhan Energi Batubara Untuk Umum tanggal 31 Desember 2021 (“Surat Ditjen Minerba 1605/2021”).
Surat Ditjen Minerba 1605/2021 melarang produsen batubara Indonesia mengekspor batubara dari 1 Januari 2022 sampai 31 Januari 2022. Surat Ditjen Minerba 1605/2021 juga mewajibkan batubara yang telah dimuat dan ditempatkan di pelabuhan muat dan/atau dimuat ke kapal, segera dialihkan dan dikirim ke perusahaan listrik nasional guna memenuhi Pemenuhan Pasar Dalam Negeri (Domestic Market Obligation/DMO).
ARMA Update akan membahas permasalahan yang timbul dari larangan ekspor tersebut terhadap aktivitas pengangkutan bagi eksportir atau penjual dan juga terhadap pemilik kapal dalam perjanjian sewa kapal.
